Terms & Conditions

1. Introduction

1.1 These Terms & Conditions together with our Privacy policy (collectively, the "Terms") govern your access to and set out the legal terms that apply to your use of Seezona ABs website www.seezona.com (the "Website") and for orders placed online on the Website. The term Website includes any of its sub-domains and any other websites operated by Seezona or on our behalf.

1.2 Seezona AB is a private company registered in Sweden with organization number 556789-7078 and registered address Riddargatan 17, 114 57 Stockholm, Sweden. When we refer to "we", "us" or "our", we mean Seezona AB.
1.3 Your access to and use of the Website is conditional upon your acceptance of and compliance with these Terms. The products sold are supplied for your domestic and private use only. By placing an order, you therefore confirm to purchase for private purposes exclusively and agree that you will not use the products for any commercial, business, or re-sale purposes. We do not have any liability to you for any loss of profit, loss of business, interruption of business, or loss of business opportunity.


2. Our services

2.1 We allow you to browse through our selection of products with the help of filters and a search function to facilitate the completion of your order. The services we offer allow you to purchase products from a large number of brands worldwide.
2.2 To order products you must be over 18 years of age and possess a valid credit or debit card (please see section 4 below for details of acceptable payment methods). By placing an order, you are promising that all details you provide are true and accurate, that you are an authorized user of the credit or debit card used to place your order, and that there are sufficient funds in the account to cover the cost of your order. The Website allows you to check your order and correct any errors before completing a purchase. Please take the time to read and check your order details as you are responsible for ensuring that the information you provide is accurate.


3. Agreement and order

3.1 You complete the checkout process and place a binding order for the items in your shopping cart by clicking the "Complete purchase" button on the checkout page. By doing so you are offering to purchase the products. Upon placement of an order, a confirmation note is shown on the Website, and you will receive an email from us with an order number confirming the receipt of your order. This email is only an acknowledgment for information purposes, and it does not constitute acceptance of your order. A binding agreement is only entered into when we confirm your purchase and send a shipping confirmation email.
3.2 We reserve the right not to accept your order if, for example, the product ordered is out of stock, is not available at the listed price, if we are unable to obtain authorization for your payment, or if you do not meet the eligibility criteria (e.g. you are under 18) if the order is being placed by the use of software, robot, crawler, spider or any automated system or scripted behavior and any use of third party services used to place an order on your behalf et cetera. Please note that we are under no obligation to deliver your order if we or our suppliers fail to deliver stock correctly or on time, despite us having followed proper ordering practice at our end as long as we have notified you of the situation without undue delay. If a product is unavailable we will refund any payments made by you without undue delay.
3.3 You consent to the assignment of Seezona’s claims for payment of the purchase price to third parties (see section 4) below.


4. Pricing and payment

4.1 When ordering, the prices set out in the offer on the Website as of the date on which the order is placed shall apply. Any applicable taxes and duties for orders will be calculated and paid at checkout, see section 4.6.
4.2 At Seezona you can pay with Credit and Debit cards, PayPal, Klarna, as well as local Payment options.

4.2.1 Credit & debit cards
We accept Visa, MasterCard, and American Express cards, and any other cards that are advertised on the Website. The purchases made with Visa and Mastercard are verified by a secure code. Please note that your card will be debited with the purchase amount once Seezona has sent you the order confirmation email. All credit/debit card transactions on the Website are processed using Adyen, a secure online payment gateway that encrypts your card details in a secure host environment. The payment will be debited and cleared from your account upon acceptance of your order by Seezona. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Seezona, your order will be canceled.
4.2.2 PayPal
When selecting PayPal as your payment option, you will be directed to the PayPal site to "Log In" and review the amount shown before clicking on "Pay Now". Once your transaction is complete, you will be redirected to Seezona's Website and the Order confirmation page.
4.2.3 Klarna
With Klarna the following payment options are available: Pay later (Pay in 30 days or Pay in 3 installments) and Pay now by card. Please read more about the Terms & Conditions when using Klarna here.
4.2.4 Local payment options
We offer local payment options for different markets. For example, Afterpay (United States), Clearpay (United Kingdom), and Swish (Sweden). All payment options advertised on the website are provided by Adyen.
4.3 When you submit your order, a standard pre-authorization check on your payment card will be made, and products will not be dispatched until the details you have provided are verified. Once we have verified your payment details and approved your order for delivery, we will notify you by email. In the unlikely event that we encounter a problem when processing your order, we will contact you and request further information to try and resolve the issue.
4.4 You consent to receive invoices and credits solely in electronic form.
4.5 Delivery/shipping costs are not included in the product prices. However, we offer free shipping for all orders. Shipping takes approximately 4-6 days internationally. Please note that some brands operate on a « made-to-order » basis, which means that some additional production time needs to be accounted for before the product can be dispatched. Read more about this under the Shipping page on the Website. Once the parcel has been picked up by the shipping courier, Seezona will send you an email with the tracking information for you to follow the progress of your order. If you have ordered from several brands, you will receive several tracking links.
4.6 Depending on your delivery address, different taxation rules and additional charges may apply. Any applicable taxes and duties will be calculated and added at checkout as a part of your order total. Please note that taxes and duties are non-refundable.
4.7 The products remain our property or the property of our relevant partner until full payment of the purchase price has been made.



5. Shipping and Delivery

5.1 The delivery of your order is organized by Seezona and is operated by UPS or FedEx, with some exceptions. Seezona will create the shipping label and the shipping courier will pick up your order either from Seezona or from our relevant partner and ship it directly to you. Shipping takes approximately 4-6 working days. It is an estimate, not a guarantee and Seezona cannot be held liable if we do not meet this timeframe. Please note that some brands operate on a “made-to-order” basis, which means that some additional production time needs to be accounted for before the product can be dispatched. Read more about this under the ”Shipping” page on the Website. Once the parcel has been picked up by the shipping courier, you will receive an email with tracking information. You may receive several tracking links as the shipping is not consolidated if you order from several brands.
5.2 You are responsible for receiving or picking up your package following the instructions you receive in connection with delivery. Packages that are not picked up within the time specified on the advice of delivery will be sent back. We have the right to charge an additional fee corresponding to our costs for shipping in cases where you do not collect your package or refuse the delivery.


6. Right of withdrawal

6.1 To exercise your right of withdrawal you must notify us of your decision to withdraw the purchase (contract) by sending us an unequivocal declaration (e.g. a letter sent by post or an e-mail). If you wish, you may use the withdrawal form below (see section 6.8), but there is no requirement to do so. Send the message to: Seezona AB, Riddargatan 17, 114 57, Stockholm, Sweden. 6.2 According to EU consumer protection legislation, you have the right to cancel your purchase (contract) within 14 days without giving any reasons. The period is 14 days from the day on which you, or a third party designated by you (but who is not the carrier), took possession of the item of the purchase, and in the case of multiple items purchased in one order, the day of possession of the last item. You will be deemed to have complied with the withdrawal period if you send your notice of withdrawal before the period has expired.
6.3 If you withdraw from your purchase we shall refund all payments received from you, including delivery costs (except any additional costs incurred as a result of you choosing a delivery method other than the lowest-cost standard delivery offered by us), without undue delay and at least within 14 days from the day on which we received your notice of withdrawal. Refunds will be processed using the same method of payment that you used for the original transaction unless expressly agreed otherwise. We will not charge you any fees for the refund. We may hold off completing your refund until we have received the item back, or you have supplied us with proof that you have returned the item, whichever occurs earlier.
6.4 We offer free returns on all orders. For further information, please see our “Returns & Refunds” page on the Website.
6.5 You are obliged to return or hand over all items to us without undue delay, but at least within 14 days from the day on which you gave us your notice of withdrawal of the purchase. This requirement is deemed satisfied if you return the items before the expiry of the 14 days.
6.6 You are liable for any diminished value of the items resulting from the handling of the items other than what is necessary to establish the nature, characteristics, and functioning of the items.
6.7 For some products, the right of withdrawal will not apply. If a product is not suitable for return due to health protection or hygiene reasons you will not be able to return the product if you have broken the seal on the product, such as pierced earrings. Also, you will not have the right of withdrawal in respect of a product that has been manufactured according to your instructions or that has otherwise been given a clear personal touch such as made-to-measure or made-to-order.

7. Defects

7.1 The relevant statutory provisions govern our liability for defects. If there is something wrong with your product, we recommend that you contact us through email at hello@seezona.com. Our customer service will then help you further.


8. Privacy Policy

8.1 We only use your personal information following our Privacy Policy. Please take the time to read it carefully, as it includes important information about how we collect and use your data. By using the Website, you consent to the use of your data as described on our ”Privacy Policy” page and you warrant that all data provided by you is accurate.


9. Our Website

9.1 This section sets out the rules that apply to your use of the Website which you agree to by using the Website. Access to the Website is permitted temporarily and it does not include any commercial use of the Website or its contents. You must not reproduce, copy, and/or exploit the Website for any commercial purposes. When you visit the Website and/or submit an order, you are communicating with us electronically and you agree that all agreements, notices, disclosures, and other communications that we send to you electronically satisfy any legal requirement that same communications be in writing. You must not use the Website in any way that causes, or is likely to cause, the Website or access to it to be interrupted, damaged, or impaired in any way.


10. Intellectual property rights

10.1 Seezona is the owner or the licensee of all intellectual property rights on the Website and its content (such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software including the presentation and compilation of the same) ("Content"). The rights on the Website and the Content are protected by international copyright laws as well as by any relevant national law concerning copyright, authors' rights, and database rights laws. All such rights are reserved. You must not extract and/or re-utilize parts of the Website or the Content. In particular, you must not use any data mining, robots, or similar data gathering and extraction tools to extract (whether once or many times) for re-utilization of any substantial parts of the Website. You must not create and/or publish your own database that features substantial parts of the Website (e.g. our prices and product listings) without our prior written consent.
10.2 Except where expressly stated to the contrary, all persons (including their names and images), third-party trademarks, and images of third-party products, services, and/or locations featured on the Website are in no way associated, linked, or affiliated with us. Any trademarks/names featured on the Website are owned by the respective trademark owners.


11. Alternative dispute resolution

11.1 As a consumer, you have the right, if you have a complaint about a purchase that has not been resolved through direct contact with us, to turn to an alternative dispute resolution body for amicable settlement. Turning to an alternative dispute resolution body is generally cheaper, less formal, and faster than going to court. You can only use this option if you are a resident within the EU. You can either use the online complaint platform available on the European Commission's website, www.ec.europa.eu/odr, or contact the Swedish General Complaints Board directly through www.arn.se. The General Complaints Board is an approved body for alternative dispute resolution and is subject to Directive 2013/11/EU on alternative dispute resolution for consumer disputes.


12. SMS marketing

12.1 By participating in our SMS program, you agree to the following terms and conditions:
12.2 Program Description: Through Seezona’s SMS program, you will receive updates such as new features on the website, promotions including exclusive discount codes, competitions, information about sales, updates on new arrivals, and after-sales messages.
12.3 Frequency: You will receive a maximum of 1-4 text messages from Seezona per month.
12.4 Opt-out: You have the right to cancel the SMS service at any time. Simply reply with STOP. Once you send the SMS message STOP to us, you will receive a confirmation SMS message confirming your unsubscribe status. After opting out, you will no longer receive SMS messages from us. If you wish to rejoin, you can simply sign up again, and we will resume sending SMS messages to you.
12.5 Help: If you encounter any issues with our messaging program, please email hello@seezona.com for assistance.
12.6 Interruption: Carriers are not liable for delayed or undelivered messages.
12.7 Cost: Standard message and data rates may apply for any messages sent to you from us and from you to us. If you have any questions about your text plan or data plan, we recommend contacting your wireless provider.

13. About the terms and Governing law and jurisdiction

13.1 We are a Swedish company with our head office in Sweden and are therefore covered by both Swedish and European law. However, you are always entitled to exercise the rights that exist for consumers in your country of domicile. This means that we will always comply with mandatory consumer protection legislation that is in force in your country.
13.2 These Terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) concerning the use of the Website or any purchase by you shall be governed by and construed following the laws of Sweden and the Swedish courts shall have non-exclusive jurisdiction. You may bring legal proceedings against us either in Sweden or in the courts of your country of residence. In addition, disputes may be submitted for online resolution to the European Commission Online Dispute Resolution platform (see section 11).
13.3 These Terms are the entire and exclusive agreement between Seezona and you regarding the Website and these Terms supersede and replace any prior agreements between Seezona and you. If any provision of these Terms is found by a proper authority to be unenforceable or invalid, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole and in such event, such provision shall be changed and interpreted to best accomplish the objectives of such unenforceable or invalid provision within the limits of applicable law or applicable court decisions.
13.4 We may change these Terms and Conditions without prior notice. However, the Terms that you approved at the time of your purchase will always apply to that purchase.
